WASNIMGTOX <br />f01Q1 <br />The Public Works Department received copies of the invoices and letter <br />from Associated Sand $ Gravzl yesterday. . <br />The information supplied by you adequately addresses the issue of materials <br />used; however, rhe stability of the material, as indicated by the letter <br />and specificaziuns, is totally dependent upon the placement and compaction <br />of the material. <br />In ytiur on-site meetings with John Fatzold and Lon Mayberry of this <br />department you were told that the City's concerns were the issues of <br />liability and maintenance. In a discussion with Jim Iles o£ the City <br />Attorney's Office, he indicated to me that a resolution satisfactory <br />to the City has not been reached with your attorney. Therefore, at this <br />time, the City has no alternative but to requiru: (1) that you provide <br />test results by an engineering geologist indicating that the material <br />was placed and compacted in a satis£actory reanner, o: (2) remove the <br />improvements and replace them according to the approved plans with the <br />City 7nspector's concurrence that the improvements are cunstructed by <br />approved construction techniques. <br />If yoi� have any further questions regarding this matter, please call me <br />at 259-8811. <br />Sincerely, <br />DfARVIN C.
