Concl.usion: The extraordinary circumstances in this case is <br />the desire to provide additional screeninq and <br />security measures between the mobile home park <br />and the apartment complex. <br />Criterion No. '� <br />That such. variance is necessary for the preservation and enjoy- <br />ment of a substantial property right of the appellant possessed <br />by the owners of ather properties in the same vicinity or zone. <br />a. Findina: Ottie1- property owners of similar type prcjects <br />have been able to satisfy the need for screening <br />and security from adjacent single family uses by <br />providing fencing and landscaping within City <br />code requirements. Granting this vari�nce would <br />a11ow the property owner to satisfy the desire <br />of the aciaoin.ing residents that there be in- <br />�reased screening and security between the two <br />uses. <br />In the past, the Hoard qranted a similar request <br />from .t single family resident adjacent to a <br />larr3e apartment complex in the Silver Lake Area. <br />b. Conc]usion• Gran�ing this ��ariance would allow the applicant <br />a ps:9perty right possessed bg others since it <br />�wild alloo� him to provide screening and secu- <br />�-ity as requested by the adjacent property own- <br />ers. <br />Criterioii No. 3; <br />That the auth^>ization of such variance will not be materially <br />detrimental '::o the public welfare or injuri.ous to property in <br />th2 vicinity or zone in whiah the property is iocate�. <br />�. F�nd�na: The increase in the fence height will provide <br />rcth additional screeninq and security for the <br />mobile home park to the north. The variance is <br />sought at the request of the adjacent mobile <br />home park and will not adversely affect any <br />other properties. In addition to the fencing, <br />the owner will be providing an extensive vegeta- <br />tive buffer along the northern edge. <br />b. Conolusion: Based on the above findings, granting this vari- <br />ance would not be detrimental to the public wel- <br />fare or injurious to others in the vicinity and <br />zone. <br />Criterion No. 4• <br />That the yrantinq of such vari.ance will not adversely affect the <br />Comprehznsive General Plan. <br />a. Findina: The General Plan designation for the site is Re- <br />gional Commercial Cent�r/Office Park; howe�er, <br />the zoning has not been changed tu implement <br />that dasignation. The pending C-1, with con- <br />tract zone that will apply to this property docs <br />permit residential use and the proposed fence <br />height variation would be for that residential <br />use. <br />
