That there are exceptional or e;ctraordinary circumstances or <br />conditions applying to the subject property or as to the inte:.ded <br />use thereof, that do not apply generaJ.ly to other properties in <br />the same vicinity or zone; <br />On January 22, 1966 the Everett City Guuncil approved a rezone <br />for 13.28 acres (Johnson Property) located east of the P.U.D. <br />right-ef-way, north of 92nd Str�et S.E. The rezone to C-1 allowed <br />the development of the site consist.ent with uses allowed in the <br />C-1 category. The rezone included a c ncomitant agreement which <br />outl.ined various performance stendtirds, setback requicements and <br />height restrictions. Revisions to that contract were approved by <br />the Everett City Council on Map 13, 1969. Those revisions <br />included: <br />Condition No. 7: To eliminate the cequiced 40 fi:,t <br />setback from the most easterly property line. <br />Condition No. 8: To modify the 15 to 25 foot height <br />limitations to allnw all structures to be built to 40 <br />feet in heighe with a 100 foot setback from the north <br />prope�ty line adjacent to the mobile home park. <br />Prior to the public haaring beEore City Council, the <br />applicant`s representative met with residents of the mobile home <br />pack, located north of the site. During thor-e meetings, the <br />residents expressed their ciesire to have an eight (8) foot fence <br />along the northern property line and a six (6) foot fence along <br />the western border extended to the access point for the <br />apaetments and along the eastern boundary. City code (.19.42.020 <br />Fences) does not allow the fence height between residential uses <br />to exceed six feet (6) or a fro�it yard fence height ove- four !4) <br />feet. The applicant agreed to pursue a variance to allow the <br />additional fence hei9ht. <br />The extraordinary circumstance in this case is the desire to <br />provida additional screening and security measuces between uses. <br />The Johnson p:operty is located betwe<n commercial uses to the <br />south, cemetery use to the east and the mobile home park to the <br />north. While this site development is conr�istent with the <br />adjacent land uses, the residents of the mobile home desire <br />additional :encing between their units and the apactments. The <br />mobile home park residents understand that the va:iance request <br />must be approved by the City.
