This <br />rezone was granted after various public meetings and hearinqs. The <br />13.6 acre site was rezoned to a C-1, General Commercial designation <br />and a rezone agreement was approved that lists eiqhteen conditions <br />ior development of the site. During the process, a site plan was <br />developed that showed the area for commercial development; however, <br />tlie rezone did not restrict any other use of the site as long as <br />they were uses permitted in the C-1 zone. <br />The project proposed for the site has been chanqed from commercial <br />development to an apartment complex called West Mall Village which <br />would consist of 381 apartment units in approximately 27 build- <br />ings, a recreation building, swimming pool, open space and trails, <br />and 527 off-strept parking spaces in open off-street parking spaces <br />and attached garages. <br />The Applicant i� requesting a revision to the concomitant agreement <br />as follows: <br />Condition No. 7 of the agreement required all structures to be set <br />back a minimum of forty feet from th.e nearest residentially znned <br />property. Th� Applicant is requesting that the r�inimum setback be <br />eliminated for the most easterly pr��perty line because even though <br />the property to the east is zoned re:3idential, the established use <br />of that property is a cemetery. <br />Condition No. 8 of the agreement limited the height of all struc•- <br />tures to a maximum of 25 feet with a 15 foot height limit within 40 <br />to 1G0 feet of the north property line adjacent to the mobile home <br />park. The Applicant is requesting a revision to the rezone zgree- <br />ment to allow a n.aximum heiqht of 40 feet with no buildings to be <br />located within 100 feet of the north property line adjacent to the <br />mobile home park. <br />PROPONSNT: Allan Johnson <br />8714 Broadway <br />Everett, S9A 98204 <br />IACATION: North of TOP Foods at 1605 S.E.
