After review of the appGcation and <br /> agency comments on the proposal, the Ciry iss�ied Preliminary Approval for the the short subdivision <br /> on February 26, 1992. An appeal of Cond�uon !/3 of Prelimu�ary Approval was rec:eived on Mazch <br /> 9, 1992, from Kegel & Assrociaces on behalf of Mr. Yerger. A public hearing on the appeal was held <br /> before the Hearing Ezaminer on May 28, 1992. On June 19, 1992, the Hearing Exauuner issueci a <br /> written decision denying the the appeal and upholding the City's decision requiring street <br /> improvements. On 7uly 22, 1992, Scott Bader, attorney representing Mr. Yerger, fileci an appea2 of <br /> the Examiner's decision to C�ty Council. <br /> OPTI02JS BEPORE COUNCIL: 1)After reviewing the record, deny the appeal and uphold the <br /> Ezaminer's decision; 2)after reviewing the record, remand the matter back to the Examiner for <br /> further consideration; 3)hold a public hearing, and, after conducting such a hearing, modify, remand, <br /> or reverse the Hearing Examiner's decision. <br /> RECOMMENDATION (Exact action requested of Council): Review the record and approve motion <br /> to deny the appeal of the Land Use Hearing Examiner's decision upholding the Ciry's decision <br /> requiring street improvements. <br /> Yergcron 5 � <br /> Z <br />
