After review of the app6carion and <br /> agency commenu on the proposal, the City issued P;eliminary Approval for the the short subdivision <br /> on February 26, 1992. An appeal of CondiUon #3 of Preliminary Approval was received on March <br /> 9, 1992, from Kegel & Agsociates on behalf of Mr. Yerger. A public hearing on the appeal was held <br /> before the Hearing Exammer on May 28, 1992. On June 19, 1992, the Hearing Ezamuier issued a <br /> written decision denying the the appeal and upholding the City's decision requiring street <br /> improvements. On July 22, 1992, Scott Bader, attoraey representing Mr. Yecger, filed an appeal of <br /> the Ezaminer's decision to City Council. <br /> OPTIONS BEFORE COUNCIL: 1)After reviewing th� record, deny the appeal and uphold the <br /> Examiner's decision; 2)after reviewing the record, remand the matter back to the Ezaminer for <br /> further consideration; 3)hold a public hearing, and, after couducting such a hearing, ruodiry, remand, <br /> or reverse the Hearing Examiner's decision. <br /> RECOMMENDATION (Exact action requested of Council): Review the record and agprove motion <br /> to deny the appeal of tbe Land Use Hearing Examiner's decision upholding the City's decision <br /> requiring street improvements.
