Lot 2 is the lot the Yergers reside on, and intend to continue to reside on. It has several existing buildir.gs on it. It is less than 21, 000 square feet. Lot 3 is a minimum 60 feet wide but is somewhat deeper and bigger than required. It also contains many trees in excess of eight inches wide. This is a develcped area in which no sidewalks presently exist. Fourth Place is fully developed (Lot 3 would be the last to be �eveloped along the street) and has no sidewalks . Ha11y Drive has wide gravel shoulders . Neither of the streets are arterials . There is plenty of room �or children aud other. pedestrians . In fact, elementary school children walk down Fourth Place and not Holly Drive to get to Emerson or St. Mary Magdalene. The Yergers have lived on the property for the last 30 years . hey have raised their family here and they have planted cultivated many of the large trees on the property. They have built their dream home here - the home they plan to spend their retirement years in. • III. ARGUMENT A.
