Memo to Hearing Examiner from Jim Hanson Dated February 3, 1994 Re: Proposed <br /> Compromise Solution <br /> All of the exhibits are available for inspection at the Hearing Examiner's Office located at <br /> 2930 Wetmore Avenue, 8th floor, Everett, Washington. <br /> After d��e consideration of the testimon�• and evidence presented by the Applicant, <br /> testimony and evidence elicited during the �ublic hearing, and as the result of the personal <br /> inspection of the subject property and surrounding areas by the Everett Hearing E�caminer, <br /> the following findings of fact and conclusions constitute the basis of the decision of the <br /> Everett Hearing Examiner. <br /> FINDINGS OF FACTS <br /> 1. EBC Associates (EBC) is the property manager of the property in the 8800 block of � <br /> Holly Drive, Everett, Washington. This parcel of land is zoned R-3, Multi-Family <br /> Low Density REsidential and is located in the Cascade neighborhood. <br /> 2. Tne property is not developed with any structures, but there is a paved 75 space p <br /> parking lot which is the primary use af the property. The parking lot was developed <br /> in 1979 and was to be used in conjunction wi*h a rnedical clinic complex that was to <br /> be built cm-site. Tfie parking lot was the aniy part cf the project that wass completed <br /> on-site, and the building was never cnnstructed. <br /> 3. Since 1979 there have been various �ses projected frr the subject property, but <br /> they have never been developed. tiowever, the parking lot has been used for <br /> psrlcin� purposes by the Federal and State governments. Both the �tate of <br /> Washington and tha United States government lease parking spaces for their <br /> emplayees. <br /> 4. In an R-3 zone, a parking lot with��ut any structures is not a permitted use. No <br /> variances or conditional uses ha�re been issued for the subject property. <br /> 5. The City inspected and approved the construction of the paved parking lot on May <br /> 24, 1979. It was not until 1993 that the City approached EBC about the parking iot � <br /> not being a permitted use in an R-3 zone. �� <br /> 6. The City presented no testimony or evidence to show that the issuance of the ���� <br /> , -� <br /> building permit tor the construction of the parking lot was illegaily obtained or given s <br /> �� <br /> in 1979. An adjoining property o�,mer testified that noise from the parking lot is a nuisance. <br /> He indicated that it has baen a nuisance since the inception of the use of the ; - ; <br /> ,»ri<ing lot in 1979.
