'b //�� �L�E.iErPc-rvi.c ��a/1.ts OcPT <br />b FjN <br />M tZTG � 3<r�0-C6Da12 Sr. <br />IIOSLED HARMLESS AGREEMENT E-1,��£n ��q 93 701 <br />92 Jul- —1R�L WER CONNECTION VARIANCE <br />to <br />Ern ; <br />Mn iNi7 ttlll li:� . <br />y J[PUI M(— <br />g N THIS AGREE <br />ENT entered into this <br />under thetlae syof theof pState of Washinygton, hereinafter <br />n o m between the City <br />of <br />Everett, a municipal carp <br />refereed to as "City", and Darrell Storkson and Ernie Miller, hereinafter referred to as <br />"Owner". <br />O N <br />WITNFSSETH: <br />�fr <br />chi WHEREAS, Owner owns property at 9513 Holly Drive and 9511 Holly Drive, <br />Everett, Washington, which is located in the County of Snohomish and legally described as <br />follows: <br />Lot 5 of the plat of Walter's Manor; and <br />WHEREAS, Owner desires to provide side sewer service for an existing house now <br />on a failing septic system; and <br />��r�P WHEREAS, EMC 14.08.180(I) authorizes the City E :gineer to waive strict <br />'�' compliance with'the provisions of EMC 14.08 when he deems physical conditions render <br />compliance impracticable provided the Owner agrees to save harmless and indemnify the City; <br />and <br />WHEREAS, Owner requests a variance to connect a side -sewer for 9513 Holly Drive <br />to the existing side -sewer of 9511 Holly Drive; and <br />WHEREAS, io lieu of being required to make the necessary physical changes to <br />accommodate the provisions of EMC 14.08, which the City Engineer finds renders compliance <br />impracticable, Owner agrees to save harmless and indemnify the City; <br />NOW, THEREFORE, THE OWNER AGREES AS FOLLOWS: <br />left AW granting the variance, and without which the City <br />1. In consideration of the Cityg g <br />would not grant the variance, the Owner agrees to defend, indemnify and save harmless the <br />r City, its appointed and elective officers, employees and agents from and against all loss of <br />r� expense including, but not limited to, judgments, settlements, attorneys fees and costs by <br />reason of any and all claims and demands upon the. City, its elected or appointed officers or <br />employees or agents, for damages because of bodily injury, including death, at any time <br />r resulting therefrom, sustained b an person or persons and on account of damage to property, <br />1. including loss of use thereof, arising out of our m consequence of the City granting Owner the <br />s fees and <br />variance.
