Tylec: <br /> Please consider this letter as our timely notice of appeal of <br /> the Supplemental Notice and Ozder of the City of Everett <br /> Building Official , which was dated May 19 , 1994 and served <br /> upon us on May 24, 1994 . <br /> We are appealing on the gcounds previously stated to you <br /> orally. Those grounds/reasons for appeal are as follows . <br /> The garage in question is fixable, though vandals have <br /> drastically damaged the roof and the garage doors , <br /> precipitating rapid deterioration. This damage was done in <br /> sevetal ways. One was repocted to us by a neighbor who <br /> claimed to have witnessed people driving a vehicle repeatedly <br /> into the door.s, thereby destroying the doucs and seriously <br /> damaging the front framework, such that it was difficult to <br /> rehang t:�e doors. We did, in fact tehang the doors two <br /> times, only to have them broken down again. Neighbocs also <br /> indicated they had seen vandals with vecy long sticks or <br /> poles going into the gaxage and poking them through the roof <br /> to knock off as many of the shingles as they could. None of <br /> this, of course, was ever tepocted to the police by the <br /> neighbors so that there could be any apprzhension of the <br /> vandals responsible. Obviously, we are the damaged paety in <br /> this situation, and the neighbots ate a very strong <br /> contributing factor ! Protecting them as potential victims <br /> when they weie major contributing factors to the hacm done to <br /> us as REAL victims seems, logically and morally, to be highly <br /> unjust. <br /> Fr.om a strictly objective viewpoint comes anothec major <br /> ce:ason why we n2ed to have an extension of time before any <br /> action must b� taken. This propetty is listed for sale <br /> through the multipie listing service. The gatage, which is <br /> the structure in question , is built co the property lines (as <br /> is true with virtually all t:�e garages on the block) . The <br /> structure is salvageable and could be remodeled and repaired. <br /> Since we do not know what a new owner would want to have <br /> done, it is extcemely and grievously harmful to both the <br /> cucrent owner as well as the pot2ntial new owner to have the <br /> current owner be forced into an action which (according to <br /> Murphy ' s Law) would undoubtedly be the opposite of what the <br /> new ownec would want to have done. <br /> r -- - <br />
