r/ January 22, 1975 <br />r <br />Roll was called on the main motion to demolish with all Councilmen voting <br />no except Councilmen Gipson,. Rucker and Kinch who voted yes. <br />Motion Lost <br />Moved by Councilman Michelson, seconded by Councilman Aldcroft that Mr. <br />Ryder be given sixty days to work on the house in an attempt to h-.:ing it <br />up to code and that the Inspection Department be instructed to notify Mr. <br />Ryder of what needed to be done. <br />Moved by Councilman Aldcroft, seconded by Councilman Ebert to amend the <br />motion instructing Mr. Ryder to immediately board up the windows and doors <br />of the house. <br />Roll was called on the amendment with all Councilmen voting yes. <br />Mo'.ion Carried <br />Roll was called on the motion as amended with all Councilmen voting yes. <br />Motion Carried <br />DEMOLITION <br />Mr. Royce then presented a report on a house at 2120 Hoyt :Ivenue owned by <br />Mr. Ronald Phelps. He said this structure was posted as uni-'ful to occupy, <br />on February 5, 1974 after it was found to be open to the public, substandard, <br />and apparently abandoned. The owner was notified of the action by letter on <br />February 25, 1974. He reviewed the notices and reports to the owner and <br />all information in connection therewith and asked that the Council adopt <br />resolution demolishing the building. <br />RESOLUTION <br />Moved by Councilman Gipson, seconded by Councilman Michelson to adopt Reso- <br />lution No. 983 as follows: <br />Whereas on the 22nd day of January, 1975 the City of Everett Building Offi- <br />cial or his duly authorized representative requested the Everett City Coun- <br />cil in regular public meeting to order the demolition of the structure as <br />specified in that certain Notice of Unsafe Building(s) dated the 3rd day of <br />June, 1974 (Unsafe Buildings Reference No. 7406-179), a duplicate original <br />copy of which is attached hereto and by this reference incorporated herein <br />as though set forth in full herein, as the owner(s) of the unsafe building(s), <br />or structure(s) or perti.on(s) thereof described in said notice has violated <br />the provisions of the City of Everett Building Code, Chanter 2.12 Everett <br />City Code adopting and amending the Uniform Building Code, 1973 Edition pre- <br />pared by the International Conference of Building Officials and further re- <br />quested the Everett City Council to order the City of Everett Building Of- <br />ficial to proceed with the work required and specified in sa'.d notice pur- <br />suant to and in accordance with said City of Everett Building Code on the <br />grounds of the failure, neglect or refusal of said owner(s) to comply with <br />the provisions of said not::ce, and <br />Whereas the Everett City Council after examining exhibits and hearing testi- <br />mony and arguments and being otherwise .fully informed in the premises makes <br />the following findings: <br />1. That said City of Everett Building Code is a valid existing ordinance <br />of the City of Everett. <br />2. That the hereinabove described Notice of Unsafe Building(s) was riroper- <br />ly issued and served pursuant to and in accordance with the hereinabove <br />described City of Everett Building Code. <br />
