24 <br />January 22, 1975 <br />3. That the City of Everett Building Official is authorized to request <br />the Everett City Council to enter the hereinabove described order <br />and that the Everett City Council is authorized in the exercise of <br />its discretion to so do under the provisions of said City of Everett <br />Building Code. <br />4. That those named in said notice as the owner(s) of said uns,Fe build- <br />ing(s), structure(s), or portion(s) thereof- were heretofo timely <br />notified that the hereinabove described request of the Cit; of <br />Everett Building Official would be presented to the Everett City <br />Council in regular public meeting on the hereinabove mentioned date <br />and that said owner(s) were further heretofore timely notified that <br />the owner(s) or duly authorized representative(s) shall have the <br />right to appear before and present such evidence and/or arguments to <br />the Everett City Council relating to the herein described matter as <br />may be desired in said regular public meeting on said date. <br />5. That the building(s), structure(s), or portion(s) thereof described <br />in said notice are unsafe and a public nuisance under the provisions <br />of said City of Everett Building Code in the respects set forth in <br />said notice. <br />6. That those named in said notice as the Qwner(s) of said unsafe Luild- <br />ing(s), structure(s), or portion(s) thereof have failed, neglected or <br />refused to comply with the provisions of said notice in violation of <br />the provisions of said City of Everett Building Code. <br />Whereas the Everett City Council upon due consideration deem it desirable <br />in the best interests of the public health, safety, property and welfare <br />that said requested order shall enter. <br />Now, therefore, be it resolved by the City Council of the City of Everett <br />as follows: <br />Section 1. The City of Everett Building Official be and hereby is authorized <br />and d cted to proceed with the work required and specified in the herein - <br />above described. Notice of Unsafe Building(s) in accordance with the provi- <br />sions of the hereinabove described City of Everett Building Code; provided, <br />however, said work shall not be commenced until not less than 10 days after <br />date of personal service or 15 days alter date of mailing.by registered mail <br />or certified mail of notice of the herein described Everett City Council <br />order (resolution) to each of these named in said Notice of Unsafe Building(s) <br />as the owner(s) of the unsafe building(s), structure(s), or portions) thereof <br />described in said Notice of Unsafe Building(s). <br />Section 2. The City of Everett Buildinq Official be and hereby is authorized <br />and directed to forthwith give notice of the herein described Everett City <br />Council order (resolution) to each of those named in the hereinabove des- <br />cribed Notice of Unsafe Building(s) as the owner(s) of the unsafe building(s) <br />structure(s), or portion(s) thereof described in said Notice of Unsafe Build- <br />ing(s). <br />Roll was called with all Councilmen voting yes except Councilmen Aldcroft and <br />Ebert who voted no. <br />LABOR AGREEMENT <br />Moved by Councilman Aldcroft, seconded <br />Mayor to sign the 1975 labor agreement <br />and Construction Trades Council. <br />Motion Carried <br />by Councilman Langus to authorize the <br />with the Snohomish County Building <br />Roll was called with all Councilmen voting yes. <br />Motion Carried <br />
