Findings: There aas nev?r a direct re:ationship bet�e<n the par�:�g <br />exempt zone and the L.I.D. boundaries since the parking exempt zone <br />aas established by Ordinance 3572 in 195o and the L.I.D. for par:sing <br />ga^age aas not authorized until iJovember 1969 vith the parking garage <br />being built in 1�T2. <br />The Darkin� Gacage L.I.D. was T`or cdnstruction of the gzrage to <br />provide pay parking for the CSD and did not cover operation and <br />maintenance of the garage ahich cost is coversd by the mont7l� <br />par�in3 rental fees. ?he cost to participa�ts in the L.Z.D. �as <br />based on the partici�nt's benefit, with those close to the garage <br />paying the most, uith lesser cost to those further away. There is <br />currently app:ozimately 100 spaces available for lease in Everpark <br />garage. <br />The zoning code (E.M.C. 79.40.060(B)(Z)) states that parking may he <br />provided ��ithin 300 feet of the building they are to serve as <br />measured along the access :oute. That such variance _� ,:ecessary __. t:^� eserva�ion and enjo�r.aea; oc <br />a substantial property right o: the appel':ant possessed by tne oKners <br />of other properties in the same vicinity or zone. <br />Finding: Ther> has been very little new construction in this <br />vicinity and zone in receni years, however, in 1986 a 16,100 sq. !'t. <br />building on the northeast corner of Colby and Everett Avenue waa <br />partially demolished and the remaining 8,G00 sq. ft. was remodeled <br />into office and a 20 stall off-street parking lot constructed to <br />serve tnat 8,000 sq. ft. of office space even though it was in the <br />ap rking exem t zone. <br />In 19A3, a 9,000 sq. ft. office building was constructed at 2931 <br />Rucker providing 28 off-street parking spaces instead of the 26 <br />required by code. <br />In 1979, SEPA Approval aas granted for a new 6�000 sq. f�. of:ice <br />building on the northeast corner of Everett Avenue and Roc;cefalle^ <br />providing 20 off-st:=et parking spaces instead o: r,he 18 ^=qui^ed by <br />code. <br />Conclusion: Other properties in this vicinity and zone ::ave provided <br />parking in excess of code requirements. <br />3. That the auihorization of such varianee crill not be materially <br />detrimental to the public welfare or injurious to propert� in t.".� <br />vicinity or zone in which the property is located. <br />Findi.n : The City Traffic Engineering Department has had continuai <br />complaints and petitions about lack of parking in this area and feels <br />that granting this variance would further deteriorate the condition <br />which :rould result in more �omplaints and oetitions �:th no way to <br />miGigate tlle problen. <br />
