Contractors shall be required to utilize SUbcontractors listed on the <br />Bid SUmmarv uniess prior approval is obtained from �tip, <br />17. Pursuant to H.U.D. requirements, no menber, officer, or enployee of the <br />City of Everett or its desiorees or agents, no member of the governing <br />body of the City of Everett, and no other public off.icial of Everett <br />shall during his tenure or for one year thereafter, have any interest, <br />thereof, for work to be performed for the Cmrmunity Housing Improvement <br />Pro9L3R1. Further, no public official of any other lorality which <br />exercises any function or responsibility with respect to the Comrtninity <br />Housing ?mprovanent Program, shall during his tenure or for one year <br />thereafter, have any interest, direct oc indirxt, in any contract or <br />sab�ntract, or the pro�eds the%of, for work to be performed for the <br />Cormnunity Housing Improvement Program. <br />18. Contractors may be suspended oc permanently renoved from the <br />Contractors List for reasons whic+� include, but are not limited to, the <br />following: <br />A. Poor quality work, as determined by the Housing Improvement <br />Advisor/Inspector. <br />B. Failure to maintain insurance. <br />C. Failure to pay Sub�ntractors. <br />D. Failure to bid responsibly in a four-month period, In such <br />instances, the Contractor shall be deleted from the List and <br />shall only be reinstated by submission of an updated application <br />to �IP for 'oan Review Comnittee approval, <br />E. Failure to r �pond to canolaints by loan recipients. <br />F. Contractor's insolvency, bankruptcy or other mnduct or mndition <br />whicf� has resulted in a monetary lass to a Owner or to the City <br />in aonnection with the �ntract work. <br />G. Abar?donment of a job or repeated failure to canplete contract <br />work within the specified time limit. <br />H. Contractor's conviction of a crime in connection with contract <br />wock oc in �;nnection with payment or reeeipt of Eunds <br />admin±stered by (�ip, <br />T. Failure to maintain cvrrent license and registrati.on within the <br />State of H�shington. <br />J. Failure to cespond to canplaints by (�Ip, <br />K• Irxiignant or dismurteous behavior towards the public, loan <br />recipients and/or CHip staff. <br />L. Conduct which in the opinion of �iip is detrimental to �Ip <br />clients or the �p program or whici� is unprofessional or which <br />reflects unfavorably on the Qlip program. <br />.... ....rw��• <br />The Loan Review Committee has jurisdiction to hear all appeals. The <br />Contractor has ten (10) days in whidi to appeal the action by �Iip, Said <br />appeal must be in writing and either hand delivered to 2731 Wetmore Avenue or <br />received by certified mail by the �IIP Office, 3002 Wetmore Avenue, Everett, <br />'•lashington, 98201, within ten (10) days from the date oE mailing the <br />notification to the Contractor of his/her renoval from the Contractors List. <br />The Loan Review Committee shall set a date for the hearing of appeal. The <br />Contractor shall be notified of said hearing date. At the hearing, CiIP will <br />show reasons why it deems it necessary to take the Contractor ofi the <br />Contractors List or not allow him/her an opportunity to participate. The <br />Contractor may then present reasons why such action should not be taken. <br />Either side shall have the right to call and examine witnesses on any matter <br />relevant, After hearing both sides and obtaining any additional information <br />it deems necessary, the Loan Review Conmittee shall issue a decision.
