Williams <br />939 Liberty <br />Marysville, WA 98270 <br />hereinafter referred to as "Applicant," for a variance from E.M.C. <br />19.40.02�7, Parking to allow: Construction of eight efficiency apartment <br />unit� and orovlde one varkinr stall ner unit inetead of the re4uired one and <br />on the folloWing described property: Lot 29 and 30, Block 789, Plat of <br />Everett, ➢iv. A <br />commonly known as: 3306 a 330' 8 Hoyt <br />C� � <br />.` � <br />The Board of Adjustment, follovin� a public hearing on said applicarion hald <br />on Novemher 2, 1987, and further having reviewed all testimony, makes the <br />follorring Fiudings, Concluaione and Order: <br />VAkIANCE CRITERIA: <br />Findings and Conclusions: <br />Criterion dl: <br />That there have <br />circumstances or <br />property or as to <br />apply genera2ly to <br />or zone. <br />been esceptional or extraordinary <br />conditions applying to the subject <br />the intended use thereof that do not <br />other properties 1❑ the same vicinity <br />a. Finding: The property coosists of two twenty-five foot <br />wide Lots and currently has one duple� structure on the <br />aite. This will be demolished prior to construction of <br />the propoaed eight. unit apartment. The applicant is <br />proposing to conatruct an eight-unit apartment building <br />with small, 500 equare root efficiency units designed for <br />the elderly. The Applicant contends that based on their <br />experience thia type of tenant neither oans nor drives a <br />car, especially i,f living close to the downtown area <br />which provides bus service within one block and medical <br />and dental services close by. <br />b. Conclusion: Even thoush the applicant may intend to <br />rent to the elderly, there is no way to guarantee this <br />happening and the unita could very well be rented by <br />yrunger people who normally have a higher ovnership and <br />uae of vehicles and sc would need pdrking as required by <br />Code; therefore, there is no unusual circumstance <br />applying to the property or the intended use. <br />Criterion 42: That auch variance ie neceseary for the preservation and <br />enjayment of a aubstantial properky right of the <br />appellant possessed by the oc�vers of other properties in <br />the same vicinity or zone. <br />a. Finding: There have been kwo okher variances granked <br />in the past for similar projecr.s with small one-bedroom <br />units, one in 1980 and one in 1985; hor;ever, during that <br />same period 1980-1985 many more permiks were issued for <br />apartments r.hat did meet the parking requiremen[ (210 <br />permits for 2,489 uni[s). <br />
