BRUST OF THE PLANNING <br />'° DIRECTOR'S DECISION <br />r <br />ra <br />N <br />ORDER <br />APPEAL #6-92 <br />On August 27, 1992, the Hearing Examiner of the City of Everett denied the appeal of <br />William P. Brust (Appellant) for a reduction of the landscaping requirements for a proposed <br />parking lot expansion at 4117 Hoyt Avenue, Everett, Washington. Pursuant to the Rules of <br />Procedure of the Hearing Examiner of the City of Everett, the Appellant filed a Motion for <br />Recoiisig,ration on September 3, 1992. The Motion for Reconsideration was received on <br />September 5, 1992. <br />A review has been made of the decision, the record developed at the hearing, and the <br />Motion for Reconsideration. Based on that review, the following is so ordered: <br />1. Finding of Fact #1 is hereby amended to reflect that the 41st Bar and Grill, which is <br />located on the subject property, is, in fact, a Class H cocktail lounge and restaurant. <br />2. All other issues raised in the Motion for Reconsideration by the Appellant are <br />denied. The issues raised constitute opinions and interpretations of the appropr'.ste <br />laws for landscaping within the City of Everett. They do not reflect any error in fact <br />as set forth in the Hearing Examiner's decision of August 27.. 1992. <br />Accordingly, the August 27, '1992, decision remains as stated except for the amendment <br />as referred to in paragraph one. <br />Done and dated this 18th day of September, 1992. <br />. 4L V <br />JYnes M.
