That such variance is necessary for the preservation and enjoyment of <br />a substantial property ri��t of the appellant possessed by the oaners <br />of other properties in the same vicinity or zons. <br />Finding: Although there are many detached acces�ory structures in <br />the vicinity with setbacks less than required by zoning regulations, <br />the requested setback of 1.5 Peet is less than customarily approved <br />by the Board of Adjustment. A three foot setback would be less than <br />required by zoning regulations, would alloN enough room for <br />maintenanca of the building and be consis:ent with past Board of <br />Adjustment ar,tions for similar requests. <br />Conclusion: A three foot side yard setbacV, would provide a reduction <br />�in the se�back requirements but would not deny the applicant a right <br />enjoyed by others. <br />3. That the authori�ation of such variance Will noti be materially <br />detrimental to the public welfare or injurious to property in tha <br />vicinity or zone in Which the property is located. <br />FLnding: Placement of a structure within 1.5 feet of the side <br />proper�y line would not allov sufficient room for building <br />construction Without requiring access onto adjoining property. The <br />Board has commonly required a three foot sotback in similac• <br />cirr.umstances. <br />Conclusion: Approval of the requ.ested variance would be detrimental <br />to the adjoining lot. A three foot setback would not be `.njurious to <br />property or improvements in the area. <br />4. T.hat the granting of sucl, variance will not adversaly affect the <br />Comprehensive Ceneral Plan. <br />Findind: The Cr.<prehensive PZan designates the propc�rty for <br />single-family resiaential use. <br />Conclusion: The reouested variance is not in conflict with the goals <br />and pollcies of the Comprehensive Plan. <br />RECOM1�NllATION: DISAPPROVE <br />DISAP°ROVE the setback requested by the variance but approve a varian�e to <br />the aetback standards to allow a detaclied garage tu be built. within three <br />feet of the side property line, subject to the following conditian: <br />� 1.
