That such variance is necessary for the preservation and enjoyment of <br />a substantial property right of the appellant possessed by the owners <br />of other properties in the same vicinity or zone. <br />Finding: Although there are many detached accessory structures in <br />the vicinity with setbacks less than required by zoning regulations, <br />the requested setback of 1.5 feet i� less than customarily approved <br />by the Board of Adjustment. A three foot setback would be less than <br />required by 2oning regulations, would allow enough room for <br />maintenance of the building and be consistent with past Hoard of <br />Adjustment actions for similar requests. <br />C�nclusion: A three foot side yard setback would provide a reduction <br />in the setback requirements but would not deny the applicant a right <br />enjoyed by others. <br />3• That the authorization of such variance will not be materially <br />detrimental to the public welfare or injurious to property in the <br />vicinity or zone in which the property is located. <br />rindlnB� Placement of a structure within 7.5 feet of the side <br />property line would not allow sufficient room for building <br />construction without requiring access onto adjoining property. The <br />Boa�d has commonly required a three foot setback in similar <br />circumstances. <br />Conclusion: Approval of the requested variance would be detrimental <br />to the adjoining lot. A three foot setback would not be injurious to <br />property or improvements in �he area. <br />4. That the granting of such variance will not adversely affeet the � <br />Comprehensive General Plan. <br />Finding: The Comprehensive Plan designates the property for <br />single-family residential use. <br />Conclusion: The requested variance is not in conflict with the goals <br />and policies of the Comprehensive Plan. <br />�RECOI4IENDATION: DISAPPROVE <br />DISAPPROVE the setback requested by the variance but approve a varianes to <br />the setback standards to allow a detached garage to be built within three <br />feet of the side property line� subject to the following condition: <br />7.
