Subsection 38.040 of the City of Everett Zoaing Cede allows <br /> the residence to be rebailt if it is damaged to any extent by fire or other casualty not <br /> intentionally caused b�� the owner, if a complete building permit application is filed <br /> within one yeaz of the �ire, and the residence has been certified as a nonconforming <br /> building. The applicant contacted the Building Department within one year ef the fire <br /> tu obtain building permits to repair the residence and was referred to ffie Planning <br /> DepartmAnt. <br /> The following requirements are the specific applicable development standards of the <br /> Flood Pringe Overlay District, Subsection 30.OSO.B.1: <br /> 1. Substantia( improvement of any residential structure shafl have the lowest floor <br /> e]Avated two feet above the base flood elevation. <br /> 2. The elevation of the site shall be tu o feet above the regulatory flood protection <br /> elevation for a distauce of 15 fee[ br.yond any structure in any direction. <br /> 3. All parking arcas and driveways sholl be no lower tlian one foot below the <br /> regulatory flood protection elevation. <br /> 4. Compliance with Federal Regulations Title 44 CFR Part 60.3 and Subsection <br /> 30.050 of the Ci!y of Everett Zoning Code. <br /> The Applicant proposes to build a new floor at an elevation of 437.37 feet high, two <br /> feet higher than the 100 year flood elevation. <br /> The applicant proposes to expand the residence along its existing r.onconforming front <br /> setback. A portion of the existing garage will be removed in order to meet the five <br /> root side setback. No portion of the residence built over 3ilver Lake will be enlarged. <br /> Subsection 38.040 of the City of Everett Zoning Code allows for the exoansion of a <br /> residence which does not meet required setbacks or height, provided that the <br /> expansion does not make d�e setback or l�eight more nonconforming, that the <br /> expansion complies wiUi all oflier requirements of the zoning code ordinance; and that <br /> the nonconforrniry has been certified by tl�e Planning Department. <br /> DECISION: The Planning Director approves tlie Slioreline Substantial Development <br /> Permit.
