Rezone Ffle i1-83 - Snohomish Cowty Public <br /> 'IYanagx£�tion Benefit Area Corpo,•ation <br /> THIS AGREEMENT made and entered this i?=� day of <br /> 1��'��=v+.-3 r.P , 19fi3, by and between the City of Everett, a municipal corpora- <br /> � tion under the laws of the State of Washington, hereinafter called "City," and <br /> Snohomish County Public Trensportation Benefit Area Corporation, hereinefter <br /> called "Owner," <br /> WITNFS3ETH: <br /> WHEREAS, the Owner has made gpplication to the City to estaGlish zoning <br /> on the parcel of property described in the O:dinance which is marked Exhibit "A," <br /> � attached hereto and incoroorated herein by reference; and ' <br /> WHEREAS, the Owner's proposEd zoning and development would create a <br /> situation where a Medium Manufacturing Zone (M-M) would abut a Sing.le-family <br /> Suburban Resideatial Zone; and <br /> WHEREAS, it is believed that the zoning of said area to permit Owner's <br /> development will be in the public health, safety and welfare of the citizens of <br /> Everett and, [urther, that the public health, safety and welfa;e of the citizens of <br /> F.ver�tt would best be served by anticipating the impact of such development and <br /> im,r,osing certain mutuaily agreed upon standards, conditions and requirements; and <br /> WHEREAS, the Owner ha, agreed to develop the aforementioned property as <br /> a h�ansit terminal in consideration of the City �onsideting designating the property <br /> M-M and the Owner further agrees as part of said consideration that should the <br /> City zone the property IVI-M, to lay out, develop and maintain the h�ansit terrninal <br /> �../ <br /> as hereinafter set forth; <br /> NOW, THEREFORE, it is mutually agreed es follows: <br /> Section 1: LIMITED USE. That the owner agrees that the layout, <br /> development and maintenance of the site shall. be limited to the Snohomish County <br /> Publ'.c Transportation Benefit Area Corporation's transit terminel as is shown on <br /> the si�e plan (which is marked Exhibit "B," attached hereto and incor�orated herein <br /> by re:erenee) es modified by this Agreement. <br /> � Section 2: AUTHORITY. That the executien of this Agreement by both <br /> parties hereta authorizes the Oµ.�er to go through a site plan review process for <br /> Phase I. Assurt�ing the C_ty's Planning Department gives final site plan ap�roval, <br />
