Gehret <br /> 5005 Spec•ry Lane <br /> Everett� WA <br /> hereinafter referred to as "Applicant," for a var'�ance from E.M.C. <br /> 19.12.050(C) to allow: <br /> a reat• yard of 10 feet instead of the 25 fce� reG!iired in tn� R-S, <br /> Single Family Suburban Residential Zone. <br /> on the following described oroperty <br /> Lot 12, Kenilworth Hills Div. ; <br /> The Poard of Ad,justment, following a public hearing on said appllcation held <br /> on April 6, 1y87 and further having reviewed all testimony, makes the <br /> following Findings, Concl�sions and Order: <br /> FINDINGS AND CONCLUSIONS: <br /> 1. That there have been exceptional or extraordinary circumstances or <br /> conditions applying to the sub,ject property or as Co the intended use <br /> thereof that do not apply generally to other or•operties in the same <br /> vicinity or zone. <br /> Finding: Lot 12 is on the northr+est corner of Kenilxorth Place, a <br /> cul-de-sac, and 23rd Avenue W. Since the length of Lot 12 is <br /> parallel to Kenilworth Place, the Zoning Code defines the easterly 25 <br /> ; feet of the lot abuGting 23rd Avenue W. as the front yard, and the <br /> ' westerly 25 feet of the lot� abutting Lot 11� as the rear yard. The <br /> rest of the lots on Keniluorth Place front on that street, so in <br /> order to conform to other developments on this street, the <br /> applicant's home should also froat towards Kenilworth Place and the <br /> plans have been designed accordingly. <br /> The applicant purchaseZ the lot because it would accommodate a larger <br /> rambler oriented tc the south� and t,ad house plans prepared <br /> accordingly xhich cannot be impl.emented if the house is reoriented to <br /> the east (i.e., facing 23rd Avenue W.), or if the spplicant is <br /> required to meet the rear yard seback of 25 feet. The proposed site <br /> plan meets all other yard requirements. Further more, if the house <br /> is situated on the site as proposed by the applicant, in effect its <br /> 10-foot rear �ard will abut the side yard of Lot 11, Kenilworth <br /> Hills, to the west, and its ample 20-foot side yard will abut the <br /> rear yard of Lot 11, Granada Seavieft Estates, to the north. <br /> Conclusion: The varianre as proposed by the Applicant appears to be <br /> a reasonable request. <br />
