� <br /> FINDINGS OF FACT <br /> 1. The Applicant requested approval of a Shoreline Permit for the <br /> development of the property on the northeast corner of Lake Heights <br /> Drive and 19th Averue SE !SR-527), Everett, Washington. The <br /> proposal is to construct a 52 bed assisted living facility in a 30,750 <br /> square foot buildiny area. There will be 26 parking stalls on-site. In <br /> addition to the Shoreline Permit, the Applicant sought Review Process II <br /> approval to alloav tiie atrium portion of the building to exceed the 28 foot <br /> neight limitation established for this zone by ar additional five feet, <br /> resuiting in a 33 foo+ high structure. Because of the close proximity of the site to Silver Lake, a significant <br /> shoreline within the State of Washington [RCW 90.58.030(2)(e)(iv)] and <br /> because �he proposed construction exceeds the $2,500 minimum <br /> threshold standard, a Sho:,;line Permit is r�quired pursuant to the <br /> provisions of RGW 90.58.1d0(2). (Exhibit 1, Cunningham testimonyJ <br /> 3. The zoniny of the subject property is B-2(B), Office. The <br /> Comprehensive General Plan designaiion of the subject property is 4.3, <br /> difice. (Exhibit 1) <br /> 4. Although the subject property is located within the City of Everett, the <br /> Everett Shoreline Master Plan has not been amended to include tlie <br /> subject property. �fhe property, hcwever, is included in the Snohomish <br /> County Shoreline Management Master Program (SCSMMP) and has an <br /> Urban designation. The project will be reviewed pursuant to the <br /> SC�MMP. The proposed project, an assisted living facility, is a <br /> permitted use in this designation. (Exhibit 1, Cunningham tastimony) <br /> 5. The City of Everett was designated as the lead agencV for the review of <br /> environmental impacts from the proposed development. On April 11, <br /> 1998, the City issued a threshold decision of Mitigated Determination of <br /> Non-Significance (MDNS). It will be a long-term occupanc�� facility that will <br /> include 52 beds. The structure and design of the facility will be similar to <br /> facilities that have been built by the Applicant in other�ommunities in <br /> 3 <br />
