Within the Ciiy of Evereit, accessory dwelliny units are limited to 15% of the lot <br />area with a maximum cf 1,0�0 square feet being allowed for each ac�essory unit. <br />Because the proposed project is less than 1,000 square feet, the ApplicanYs <br />proposal satisfies th�s standard. (exhibit 1, staff report) <br />10. Accessory buildings that are over 500 square feet must have siding and roofing <br />materials and ro��f pitch that are similar and compatible with the dwelling. The <br />proposed garage would have a roof pitch of 12/12 wrich is similar to the dwelling. <br />It would also have wood siding compatible with the existing dwelling and would <br />have a coordinated color scheme with thE existing residence. (exhibit 1, staff <br />report) <br />11. Notice was given for the requesi, but no public testimony was submitted in the <br />form of correspondence or at the public hearing. <br />12. The City concluded that tl�e proposed garage would not have a significant impact <br />upon the surrounding neighborhoods, would not obstruct views from lhe <br />neighboring properties, and would be consistent with the construction standards <br />of the existing residence. (exliibit 1, staff report; Tyler testimony) <br />CONCLUSIONS OF LAV�! <br />Jurisdiction <br />Jurisdicfion: The Nearing Examiner of the City of Everett has jurisdictional authorrty to <br />hold a hearing and fo issue the decision. That authority is set forth in EMC 15.16.100. <br />Based on the above Findings of Fact, the Hearing Examrner enters the following <br />Concfusions: <br />Criteria and Standards for Review <br />EMC 19.7.020.K The Hearing Examiner, using the rnview process described in EMC, <br />Tille 15, Local Project Review Procedur2s, may allow detached accessory buildings to <br />exceed 15 feet in he�ght, or to exceed 1,000 square feet in area, as provided herein. <br />The fiearing Examiner shall have the authority to deny an application for accessory <br />buildings �vhich exceed 15 feet in height or a total of 1,000 square feet. � i�e basis for <br />denial is incompatibility witF lhe dwelling and/or neighborhood character. To make this <br />determination, the Hearing Examiner may look to such factors ihat include, but are not <br />limited to, view obstruction, aeslhetic impact on surrounding properties and streetscape, <br />incompatible scale with dwellings on surrounding properties, and impact on <br />neighborhood character. <br />
