FINDINGS AND CONCLUSIONS: <br />Criterion No. 1: <br />That the variance is necessary because of exceptional or extraordinary circumstances <br />regarding the size, shape, topography, or location of the subject property; or the location of a <br />pre-existing improvement on the subject property that conformed to the zoning code in effect <br />when the improvement was constructed. <br />a. Findings: The existing barn was constructed in 1984. In 1984, the regulatory <br />flood protection elevation was 17.7 feet. The regulatory flood protection <br />elevation is now approximately 20 feet. <br />b. Conclusions:. The existing barn conformed to the zoning code in effect at the <br />time it was constructed. <br />Criterion No. . <br />That the variance will not be materially detrimental to the property in the area of the subject <br />property or to the City as a whole. <br />a. Findings:. The addition will be to the east of the existing barn and not be visible <br />from the street. There are no nearby residential structures to the east. <br />b. Conclusions: The addition will not be materially detrimental to the properties in <br />the area.. <br />Criterion No. 3. <br />That the variance will only grant the subject property the same qeneral rights enjoyed by <br />other property in the same area and zone as the subject property. <br />a. Findings: Other properties have accessory buildings within the flood fringe and <br />the floodway that are not elevated above the regulatory flood protection <br />elevation. <br />b. Conclusions: The variance will grant the subject property the same general <br />right as enjoyed by other existing accessory structures in the area . <br />Criterion No. 4: <br />That the variance is the minimum necessary to allow the subject property the general rights <br />described in Criterion 3. <br />a. Findings. The applicant needs to match the addition's floor elevation with the <br />existing barn's floor elevation. This will allow the driveway to remain even. <br />b. Conclusions: The variance is the minimum necessary. <br />
