( <br />� <br />NOTICL OF CITY ACTION <br />PLANNING DIRECTOR �ECISION <br />Revie,v Process I NO1-021 <br />July 6, 2001 <br />The City of Everett Planning Director grants ap�roval of a request by <br />Itobin Kearsley to construct a�ortiun of a 14' X 28' addition, 4' X 12' <br />sunroom, and a 552 square foot deck within the 25-foot buffer from the top <br />of slope at 500 Laurel Drive with the following conditions: <br />I. Obtain a building permit. <br />2. All work must comply with th� Geotechnical Engineering Study prepared by <br />Creative Engineering Optiois Ina (CEO) dated January 31, 2001. The <br />buildings plans must be reviewed and approved by CEO prior to issuance of <br />building permits. <br />3. The applicant must record an Environmentally Sen�itivA Area Covenant for <br />the slope area. <br />4. The applicant must prepare a covenant running with the land wLich waives <br />claims against rhe City> its officers, employees and agents, and indemnifies <br />(including reasonable atcorney's fees), defends and saves the City, its <br />officers, employees and agents harmless from any loss or damage to people <br />or property either on or off the subject properry resulting from any form of <br />soil movemen: whatsoever :::�d/or from any form of failure in design and/or <br />construction of the improvements thcreon whatsoever. The owners of the <br />subject property shall provide the Ciry with th? covenant and it shaU be <br />signed and acknowledged Cy all parties with an interest in the pro�erry. <br />Tlie covenant shaIl also provide notice concerning the presence of <br />enviro��mentally sensitive features on die property. The covenan[ must be <br />presentea to the City Attorney for re� ew and approval and, upoa approval, <br />recorded by the applicant with tlte Snonomish County Auditor prior to final <br />approval for the subject development. <br />The northwest corner of the proposed addition will be approximatelV 22.5 f.:et <br />from the top of slope. A deck will be placed approximately 16 feet fi�om the <br />top of slope. The slope estends do�vn towards the railroad tracks locared a(ong <br />the toe of the slope approximately 120 feet below. The slope exceeds 4C%. <br />Subsection 37.040.D of the Ciry of Everet[ Zoning Code designates slopes of <br />40% or greater as an environmentally sensitive feature.
