The Board of Adjustment has jurisdiction to ailow deviations from the <br />setback requirements upon private property and finds that the <br />requested varia�ce would not be detrimental to the subject property <br />or to other properties in the arf:a of the subject property. <br />Criterion �o. 3: <br />That the variarce will only grant the subjecl property the same general rights <br />enjoyed by other property in the same area and zone as the subject property. <br />Findinns: The applicant has stated that majority of the homes within <br />the imrc�ediate vicinity can expand without the need for a variance <br />due to their placement on site; ho�vever the subject residence is <br />located in the northwest corner with the front of the residence facing <br />east. <br />Majority of the homes in this area of town were constructed prior to <br />the Zoning Code coming into effect. Several, like the subject <br />residence, do have legal nonconforming setbacks due to the age of <br />the original construction. <br />b. Conclusions: The subject residence is located wifhin the Rucker <br />Hill National Register Historic District. Majority of these homes were <br />constructed in the early 1900's prior to any zoning code provisions. <br />Several may have existing legal non-conforming setbacks, similar lo <br />the subject residence. TF;e proposed expansion will be screened <br />from view by existing mature vegetation, and will not create any view <br />biockage. <br />Criterion No. 4: <br />That the variance is the minimum necessary to a��ow !he subject property the <br />general rights described in Criterion 3. <br />a. Findin s: See Criteria #3. <br />b. Conclusions: See Crteria »3 <br />Criterion No. 5: <br />The granting of the variance is consistent with the goals and pe!icies of the <br />Everett General Plan. <br />Findin s: The Everett General Plan designates this property as 1.2 <br />Single Fa�„ily Detached, 5-10 Dwellings per gross acre. <br />b.
