It has come to my attention that some problems <br />with this unit pose a condition that, "substantially endangers...the health or safety," (RCW <br />59.18.060(1) ) of my family and I. RCW 59.18.060 Landlord -- Duties, requires: <br />Tile landlord will at all times during the tenancy keep the premises fit for human <br />habitation, and shall in particular: <br />(1) Maintain the premises to substantially comply with any applicable code, statute, <br />ordinance, or regulation governing their maintenance cr operation, which the legislative <br />body enacting the applicable code, statute, ordinance or regulation could enforce as to the <br />premises rented if such condition substantially endangers or impairs the health or safety <br />of the tenant." <br />Although Michael responded to my inquiry in a telephone conversation on July 29 that "yes" <br />permits had been taken out in the construction of this unit, and despite Michael's claim in the <br />same conversation that this was an existing living space that he had only improved, I was told <br />by both Michael and Michelle, that Michael himself had constructed the apartment in what was <br />only a rough basement space, and the City of Everett has no record of permits being taken out to <br />perform cite electrical, mechanical, plumbing, or, physical alteration that was done to create this, <br />living space., Because this work was performed app[omiXttately 3 years ago as clearly evidenecd <br />by manufacture date oil materials used in the construction, and because of the nature of the work <br />done, permits would be required that require the work be completed in conformity with the <br />Uniform Building Code and the National Electrical Code as adopted by the City of Everett. <br />Because permits were npt taken put at, the time of construction, all work must he compliant with <br />the most recently adopted code.- The following discrepancies in the construction of this unit that <br />make it wholly uninhabitable are herewith noted but not limited to the following. <br />1) The windows in the sleeping'7061111§ are substandard as fire egress', the installed windows <br />have a finish sill height of 57" from the floor and a clear opening of 1.4 sq.ft.. Section 310 4 of <br />the UBC requires: <br />Basements in dwelling units and every sleeping room below the fourth story shall have at <br />least one operable window or exterior door approved for emergency egress or rescue <br />The units shall be operable from the inside to provide a full clear opening without the use <br />of separate tools. <br />14 <br />
