WASHINGTON <br />Item V, Agenda of October 1, 1979 <br />Board of Adjustment Hearing <br />Having received the Board of Adjustment package on September 26, 1979, <br />for the Variance Hearing on a request at Lot 31 plat of Ibberson Park for a <br />front yard variance of one (1) foot from public right-of-way rather than 20 <br />feet as required by Code has not provided adequate time for the City to do <br />an adequate review. <br />City Records indicate that right-of-way shown on sketch to the South of Lot <br />31 is not a public right-of-way. Ownership of the property may be attached <br />to Lot 31 or it may not be attached to Lot 31. In any case our records indicate <br />that it is not public ownership and side yard set backs of five (5) feet would <br />properly apply. <br />Public Works does not object to a side yard set back variance from five (5) <br />feet to one (1) foot. <br />HOWEVER <br />West Ibberson Road is the front yard side. Lot 31 is not a corner lot and the <br />plans submitted do not reflect the proper set back requirement of 20 feet <br />from West Ibberson. This point becomes critical when looked at from the <br />prospective that the existing right-of-way width of West Ibberson is 20 feet. <br />When West Ibberson is improved - - the minimum necessary street improvement <br />will need to be 20 plus a pedestrian facility. <br />Fire Codes require 20 feet of unobstructed improved access. <br />City of Everett Ordinance 555-78 that requires every developer to provide <br />for street improvements will require that this site dedicate additional property <br />to the City (actual standard application would be 15 feet of new right-of- <br />way required). Public Works will require five (5) feet, less than five (5) feet <br />will require City Council approval. <br />Ordinance 555 requires set back from the new property line. Using the set <br />back from the new line will present some special problems for the developer <br />of that lot and a request for a Variance would be supported by Public Works <br />up to five (5) feet from the new right-of-way. <br />Recommendation: <br />It is recommended that the Board grant the one (1) foot side yard variance <br />and the applicant submit a new variance request for West Ibberson Road set back. <br />
