Pucsuant to H.U.D. requirements, no member, officer, or �loyee of the <br /> City of �4erett or its designees o� agents, no melnber of the governing <br /> body of the City of �+erett, and no other public official of F.berett <br /> shall during his tenure or for one year thereafter, have any interest, <br /> direct or indirect, in a��y contract or subcontract, or the proceeds <br /> thereof, fo[ r+ork to be pecformed for the Community Housing I�rovertient <br /> Pro9ram. Elirther, no public official of any other locality which <br /> exercises any function or cesponsibility with respect to the Comnunity <br /> Housing L�rovement Program, shall during his tenure or for one year <br /> thereafter, have any interest, direct or indirect, in any contract or <br /> suboontract, or the proceeds thereof, for work to be perfocrted for the <br /> Oonmunity Housing Improvement Program. <br /> 18. Contractors may be suspended or pernanently removed from the <br /> Contractors List. A contractor may be suspended or removed for reasons <br /> which include but are not limited to the Eollowing: <br /> A. Poor quality work, as determined by the Housing Improvement <br /> Advisor/Inspector. <br /> B. Failure to maintain insurance. <br /> C. Failure to,pny suboontractors. <br /> D. Failure to bid reaponsibility in a four month period. In such <br /> instances, the aontractor shall be deleted fcan the List and <br /> shall only be reinatated by su6mission of an updated application <br /> � to �tIP for Loan Review mittee approval. <br /> j E. Failure to respond to co�laints by loan recipients. <br /> � <br /> F. Contractor's insolvency, bankruptcy, or other conduct or <br /> condition which has resulted in a monetary loss to a homeowner or <br /> to the City in connection with the rnntract work. <br /> G. Abnndonment oE a job or repeated failure to complete contract <br /> work within t2x specified time limit. <br /> H. Contractor's conviction of a crime in connection with contract <br /> work or in aoru�ection with payment oc receipt of funds <br /> a�ninistered by C�iIP. <br /> I. Failure to maintain current license and registration within the <br /> State of Washington. <br /> J. Failure to respond to oomplaints by CHIP. <br /> � � K. Indignant or discourteous behavior towards the public, loan <br /> recipients and/or �iIP staff. <br /> Satisfactor Co letion of First Contract. My contcactor must satisfactorily <br /> ' ca� ete one CHIP loan re ab tat on contract before being permitted to bid <br /> those projecta which are, in the Housing L�rovement Advisor/Inspector's <br /> estimation, $15,000.00 or more. <br /> . A�peal Pcocedure <br /> �ltie Loan Review Cortmittee has jurisdiction to hear all appeals. '[he <br /> contractoc has ten (10) days in which to appeal the action by CHIP. Said <br /> appeal nust be in writing and either hand delivered or received by certified <br /> mail by the CHIP oEfice, 3002 Wetmore, hVerett, Washington, 98201, within ten <br /> (10) days from the date of mailing the notification to the contractor of <br /> ..'__^:=r se^.aval fran the Contractors List. <br /> 1fie Loan Review Cortmittee shall set a date Eor the hearing oE appeal. 'fie <br /> contractor shall be notified of said hearing date. At the hearing. CHIP will <br /> show reasons why it deems it necessary to take the contractor off the <br /> Contractors List or not allow him/her an opportunity to participate. '[he <br /> contractor may then present reasons why such action should not be taken. <br /> Either side shall have the right to call and examine witnesses on any matter <br /> relevant. After hearing both sides and obtaining any additional inEormation <br /> it deems necessary, the Loan Review Comnittee shall issue a decision.
