r <br />' <br />September 8, 1975 <br />The regular meeting of the Everett Board of Adjustment was called <br />to order at 7:30 p.m. in the City Ball Council Chambers by Chair- <br />man Robert Graff. Members present were Mr. Baird, Mr. Berg, and <br />Mr. Cronin. Mr. Bartlett was absent. <br />The reading of the minutes of the previous meeting was dispensed <br />with. <br />Under old business a hearing was held on the application of Can - <br />Am Brokerage, Inc. (J. Colin Tassin), 1200 Westlake Avenue North, <br />Seattle, Washington for a variance from Chapter 19.40 Everett <br />Municipal Code (Off-street parking) for permission to establish a <br />restaurant in an existing business building and provide a maximum <br />of twelve off-street parking stalls (existing) rather than the <br />minimum of 35 parking stalls as required by Code. <br />Legal Description: Lots 1, 2, and 3, Block 697--Swalwell's <br />First Addition. 3120 Hewitt (Cast;.e Tavern) <br />Zoning: C-2, Heavy Commercial -Light Manufacturing <br />The Can -Am Brokerage Inc. told the Board they would need 27 parking <br />stalls for the amount of square footage they will be using rather <br />than the 35 as indicated. The parking would only be needed after <br />5:00 p.m. and at this time the streets can easily be used for park- <br />ing without interfering with an employer's parking. <br />Mr. Mike Lewis, owner of adjacent property, objected to the grant- <br />ing of the variance as he felt it would affect the saleability of <br />his property at some future time. <br />After visually viewing the subject property and considering all <br />the facts, it was moved by Mr. Baird, seconded by Mr. Cronin and <br />unanimously carried to grant the applicant's request for the <br />following reasons: <br />1. There are exceptional circumstances applying to the <br />subject property that do not apply to other proper- <br />ties in the same vicinity; specifically, that the <br />huilding is an old building established in the <br />lower Hewitt area, long before the present parking <br />requirements were established and no structural <br />changes were being made to that portion of the <br />building presently being occupied. <br />2. That the variance is necessary for the preservation <br />and enjoyment of a substantial property right; <br />specifically, the other buildings in the area <br />were also constructed without off-street parking. <br />
