CTTY nF M71-RETT - nnARD OF ADJUSTMENT <br />ORDER <br />WHEREAS, theretofore, there was filed with the City of <br />Everett Planning Department on (date) July 22, 1975 an <br />application for a variance from Chapter 19.40 of Everett Munici- <br />pal Code by (applicant) Can -Am Brokerage, Inc. <br />(address) Suite 209, 1200 Westlake Avenue North, Seattle, WA 98109 <br />for (specific variance requested): <br />Permission to establish a restaurant on the second floor <br />of an existing business building and.provide a maximum <br />of twelve off-street parking stalls (existing) rather <br />than the minimum of twenty-seven parking stalls as re- <br />quired by Code. <br />on the following described property: <br />Lots 1, 2 and 3, Block 697. Swalwell's First Addition. <br />Address: 3120 Hewitt Avenue (Castle Tavern) <br />AND: WHEREAS, (date) September 8, 1975 was fixed as the f <br />date of hearing on said application and proper notice having been IEI <br />given as required by law, <br />AND: WHEREAS, a public hearing was held on said date and the <br />Board of Adjustment, after reviewing all testimony, made the find- <br />ings that: <br />1. There are exceptional circumstances applying to the <br />subject property that do not apply to other proper- <br />ties in the same vicinity; specifically, that the <br />building is an old building established in the <br />lower Hewitt area, long before the present parking <br />requirements were established and no structural <br />changes were being made to that portion of the <br />building presently being occupied. <br />2. That the variance is necessary for the preserva- <br />tion and enjoyment of a substantial property right; <br />specifically, the other buildings in the area were <br />also constructed without off-street parking. <br />3. The granting of the variance will not adversely <br />affect the Comprehensive Land Use Plan. <br />NOW, THEREFORE, based on the foregoing findings: <br />BE IT ORDERED BY THE CITY OF EVERETT BOARD OF AnJUSTMENT that said <br />application be GRANTED with the following stinulations: <br />1. The restaurant would not be open for customer ser- <br />vice before 5:00 p.m. <br />2.
