This appeal involves a good-faith disagreement over the legal status of a roof-mounted <br />sign (tlie "Sign") located on a building owned by the appellant with a common address of <br />2925 Cheslnul, Everett, WA. <br />2. The parties have agreed upon a voluntary resolution af the dispute thal is in lhe public <br />interest and is consistent wilh the purpose and intent o( the sign code, chapter 19.36 EMC. <br />3. Wilhin 60 days of llie date that an order dismissing this action is issued by the Hearing <br />[xaminer, the appellant shall submit to lhe Building Official in(ormation sufficient to <br />demonslrate Ihal the sign and supporling slruclure pose no risk to public safety. The <br />Duilding Of(icial shall either approve the application as submitted or approve the application <br />condilioned.upon structural modifications that, in lhe judgment of the Building Official, are <br />necessary to prolect public safery and to bring the slructure into compliance with applicable <br />buildinc� and sign code siruclural and safety requirements.
