(19) The Contractor shall, at his/her ortn ezpense, provide fla�en, ,hall furnish all signs, barricades, guards, conetruction warnings, and night lights in order to protect the public at all times from injury as a reault of his operation. (20) The Contractor shall be responaible for controlling dust a¢d mud vithin the project limi.ts. The Contractor ahall be prepared to use watering trucks, power sweepers, and any other piecea of equipment neceesary to avoid creating a nuisance. All roads used by his/her operatiou shall be thoroughly cleaned at the e¢d of each work day. Any damage caueed by duat and/or mud shall be the sole reeponaibility of the Contractor. All r+ork required by ehis Section st�all be couaidered to be incidental to other Stems of work, and no extra payment shall be made for duet and mud control. (21) Any notice from one party to th: other party under the Contract ahall be in writing and shall ',e dated and signed by the party giving auch notice or by the �.uly authorized representative of such party. Any euch notice as heretofore specified shall be by peraonal delivery thereof or by depoeiting same in the United Statea Mail, postage prepaid and registered. (22) In the event a claim shall be filed agalnet the CSty growing and arieing out of the performance of the Cantract by the Contractor vhether baeeless or not, the City shall have the right to retaln from the sum due the Contractor sufficient money to satiafy the claim until said claim has been withdravn or diamisaed by a court of competent juriadictioa. In the event the City is exempt from sales tax, then the Contractor should be ��--� careful to ascertain the tax applicable to his/her purchaeea.
