BOARD OF ADJUSTMENT <br />FINDINGS, CONCLUSIONS AND ORDER <br />VARIANCE #00-008 <br />Applicant: Prime Equipment/Chuck Sorger <br />3409 Everett Ave <br />Everett, WA 98201 <br />Site Location: 2810 Highland Ave <br />hereinafter referred to as "Applicant," for a variance from Section 36.200.A.3 of <br />the City's Zoning Code which requires that a non -conforming roof sign be <br />removed or brought into conformance whenever a building is expanded or <br />remodeled upon which a non -conforming roof sign is located. The site is <br />undergoing a major expansion project which includes an approximately 4,330 <br />sq.ft. new office/retail addition to the existing service area and a new 2,200 sq.ft. <br />canopy addition. Board of Adjustment Minutes from December 4, 2000 <br />FINDINGS AND CONCLUSIONS: <br />Criterion No.1: <br />That the variance is necessary because of exceptional or extraordinary <br />circumstances regarding the size, shape, topography, or location of the <br />subject property; or the location of a pre-existing improvement on the <br />subject property that conformed to the zoning code in effect when the <br />improvement was constructed. <br />a. Findim s: The applicant states that the variance is necessary <br />due to the completion of the new Hwy 2 on ramp which blocks <br />visibility to the site which is impaired on three sides. <br />The existing roof sign is deemed a non -conforming sign <br />because it is located on the roof. The City's Zoning Code <br />requires that when a building upon which a roof sign is located <br />is remodeled or expanded that any such roof sign shall be <br />removed or brought into conformance with the current sign <br />code. The intent of this requirement is to provide a <br />mechanism which would eventually result in the relocation or <br />removal of roof signs over time as each building upon which a <br />roof sign is located is upgraded by remodel and/or expansion. <br />
