Box 366 <br />Kenmore,'WA. 98028 <br />Re: K & J Construction, Inc. - Jules Van Der Meersche - <br />Agreement of April 18, 1979 <br />Dear Mr. Maas: <br />I have examined your letter of March 20, 1980, and have <br />discussed the same with my client, Jules Van Der Meersche. <br />Mr.- Vdn Der Meersche is not agreeable to any of the alter- <br />natives proposed in said letter. <br />Mr. Van Der Meersche does have the balance of the monies <br />that would be owing to your client under the original <br />agreement of 4-18-79, excepting that he will in no way <br />part with any money to your client, under the circum- <br />stances, and, in fact, does claim extensive damages caused <br />by your client's willful failure to fulfill his part of <br />the original agreement. Be that as it may, in an attempt <br />to settle this matter by compromise, I have recommended <br />to my client that he place the entire sum due and owing <br />to your client in an escrow account, which will be payable <br />upon your client's delivering the house to the lot in <br />question. Unfortunately, we received, in the meantime, <br />a copy of the letter from Wyckoff & Martinson, a copy <br />of which was delivered or sent directly to your client, <br />dated March 20, 1980, wherein Associated Development, <br />Inc., the original sellers of the house, claim that the <br />sale failed by virtue of the provisions of that original <br />sale agreement. <br />I have never seen said agreement but am taking the position <br />that those conditions cannot effect my client's rights, <br />inasmuch as he purchased the same and became the c..ner <br />thereof by virtue of the 4-18-79 agreement.
