Section 302(13) - Besides violating the Uniform Abatement of Dangerous <br />Building Code, the building is in violation of Section 1001(d) and (L) of the 1979 Uniform <br />Housing Code; it is in violation of the 1979 Uniform Building Code; it is in violation of <br />Everett Municipal Code 13.28 - Right of Way Use; and it is in violation of the City's <br />Zoning Code. <br />6. Section 302(17) - The building is a nuisance pursuant to RCW 7.48.120 in <br />that it renders dangerous for passage a public street. <br />7. Section 302(18) - The building is an attractive nuisance which may prove <br />detrimental to children. It is also a hazard to the public. <br />II. <br />That portion of the building which is located on the public right of way shall be <br />demolished or moved off of the public right of way. In the alternative, the entire <br />building shall be demolished or moved off of the public right of way. In the event the <br />building is demolished, the materials, rubble and debris therefrom shall be removed and <br />the lot cleared. <br />Since the building is presently uninhabitable in its present condition, it shall <br />remain vacant and secured to prevent entry. <br />IV. <br />All permits required for the demolition or moving of the building must be <br />secured within thirty (30) days from the date of this Order, and the demolition or move <br />must be completed within forty-five (45) days of the date of this Order. <br />V. <br />If the required demolition or moving of the building is not commenced within the <br />time specified in Paragraph IV, the Building Official will order the building to remain <br />-2- <br />
