V Permittee agrees to save harmless the City of Everett for any claim for damage to person or property arising; out of its use and occupancy of the premises. VI Permittee has examined the premises and knows the condition thereof, and waives any claim it- may have against the City of Everett arising out of use and occupancy of the premises by permittee, including any damages that may be suffered by permittee by reason of the operation of the City's utilities.
