c <br />� <br />PLANNING DIRECTOR DETERMINATION <br />ESA N06-002 <br />July 25, 2006 <br />The Ciry of Everett Planning Director grants upproval of a request by Heather Homes to place up to <br />308 squarc feet of yard area �vithin a 75-foot buffcr of a Category II wedand on Lot 31 (19XX Hollow <br />Dale Pl;,ce) with the following conditions: <br />1. Comply w�di the mitigation plan by The Jay Group dated April 26, 2006. This includes removing <br />GII, lumber, anu trash frnm thc huf'fcr and replanting al1 disturbed �reas. Addiuonal plants at 1/3 the <br />Jensiry of Qie mitigation plan's planting plan must he plantcd in the areas not shown to be replanted on <br />the mitigation plan. <br />2. Construct a permanent fence along �he edge of the riparian we!land buffer. A Critical Area sign <br />must be placed on the fence. <br />3. RecorJ a Critical Area Protecti��e Covenant ihat designates the riparian wetland and huffer as <br />shown on the approved site plan prior ro issuance of Ihe huilding permit. <br />4. Enhancement of the remaining buffer and d�c construction of the fence must be completed prior to <br />issuance of building pennits or may be completed :�fter issuancc of building permits if an assurance <br />device ���orth 300�7, of thc cost of planting and fencing is pro��idcd to the City of Everett. <br />This approval is permittcd per GMC 19.37.IOO.P, IIuffer Width Averaging. This chapter allows <br />buffer ��•i�lih averaging pro��ideJ d�at the averaging �vill not reduce the wetland functional values. The <br />applica�d ��ioposes tu construct t�ti�o single family residences on a triangle shaped lot approximately �'a- <br />acre in sizc. There is a Category lll slream with a riparian �vedand, Category ❑, which flows <br />southerly along the westcrn edge of the site as determined by The Jay Group in a smdy dated April <br />26, 2006 and by Cel�ste F3otha 1'��cdand Gcology in a I3iological Evaluation dated December R. 1999. <br />Illegal fill has hcen placed on thc lot and encroaches up to 35 feet into the rcyuired 75-foot huffer. <br />"I'he till will hc removed from the buffer and thc disturbed areas will be rcplanted except for 308 <br />syuare lect which ���ill heconte yard arca for the ne��� single fantily residencc. To replace the loss of <br />308 syuare fect of huffer, approximatcly 1,978 squarc feet of area at the south end of the site �vill be <br />placeJ within the buffer.
