8. The Applicant was informed of the City's recommendation of approval subject to <br /> four conditions as set forth in exhibit 1, the staff report. At the public hearing, the <br /> Applicant voiced no opposition to the proposed conditions and accepted the <br /> City's recomme�dation. (Weatherhogge testimony) <br /> CONCLUSIONS OF LAW <br /> Jurisdiction <br /> Jurisdiction: The Hearing Examiner of the City of Everett has jurisdictional authority to <br /> hold a hearing and to issue the decision. That authority is set forth in EMC 15.16.100. <br /> Based on the above Findin�s of Fact, the Hearing Examiner anters the following <br /> Conclusions: <br /> Criteria and Standards for Review <br /> EMC 19.7.020.K. The Hearing Examiner, using the review process described in EMC, <br /> Title 15, Local Project Review Procedures, may allow detached accessory buildings to <br /> exceed 15 feet in height, or to exceed 1,OJ0 square feet in area, as provided herein. <br /> The Hearing Fxaminer shall have the authority to deny an application for accessory <br /> buildings which exceed 15 feet in height or a total of 1,000 square feet. The basis for <br /> denial is incompalibility wilh lhe dwelling and/or neighborhood character. To make this <br /> determination, the Hearing Examiner may look to such factors that include, but are not <br /> limiled to, view obstruction, aesthetic impact on surrounding properties and streetscape, <br /> incompatible scale with dwellings on surrounding properties, and impact on <br /> neighborhood character. EMC 19.7.020.K allows the Hearing Examiner to issue <br /> excepiions pursuant to the provisions of EMC 19.7.020.H. <br /> CONCLUSIONS BASED ON FINDINGS <br /> 1. The Applicant is the owner of the property at 2412 Easl Grand Avenue, Everett, <br /> Washington (subject property). The property is zoned R-2, Single-Family <br /> Detached Medium Densiiy and has a Comprehensive Plan designation of 1.3, <br /> Single-Family Detached, 5-10 units per acre. (finding 1) <br /> � 2. The proposed detached garage built to a height of 18' 2." would not create any <br /> view obstructions from other properties and would not have any impacts on <br /> surrounding properties. The design of the structure would include a roof pitch of <br /> 6/12 which is consistent with surrounding properties. The proposed structure, <br /> with the increased height, would be compatible wiih the surrounding properties <br /> and the character of the neighborhood. (findings 3-6) <br /> DECISION <br /> Based upon the preceding Findings of Fact and Conclusions and testimony and <br /> evidence submitted al lhe public hearing, it is hereby ordered that lhe requested <br /> 3-'� <br />
