PLANNING DIRECTOR DETERMINATION <br /> Expansion of Non-conforming Building Setback <br /> Review Process II #01-014 <br /> INTRODUCTION: The City of Everett Planning Department has received an application from John Tanaka, <br /> 1502 Grand Avenue, Everett, WA 98201, to install a deck/carport addition to an existing house along a <br /> nonconforming setback. The existing residence has a three-foot setback from the intemal property line. The <br /> expansion would continue to the west along this three-foot setback line. Section 38.040 allows for the <br /> Planning Director to approve the expansion of a stnicture which does not meet required setbacks, provided <br /> that the expansion does not make the setback more nonconforming; that the expansion compl'.es with all other <br /> requirements of the zoning ordinance; and that the nonconformity has been certified by the Planning <br /> Department. <br /> BACKGROUND: The property is located in th�� R-2 H, Single Family Detached Medium Density Zone with <br /> Historic Overlay. The required setback is 5' from an interior property line for all structures. There is an existing <br /> single family residence on site. This structure is considered legal non-conforming or"grandfathered" as it <br /> predates the City's zoning code requirement for structures to have a minimum setback of five feet (5')from the <br /> intemal side property line. The applicant proposes to make an addition of 11' X 21' to the existing residence. <br /> The new structure will have a three-foot setback from lhe southern property line, consistent with the existing <br /> structure. <br /> FINDINGS: The existing residence has been certified as legal nonconforming related to setbacks (NCB#01- <br /> 011). The applicant proposes to make an addition of 11' X 21' to the existing residence. The new structure will <br /> have a three-foot setback from the interior side property line consistent with the existing non-conforming <br /> setback, and will not create any further non-conformities than presently exists. <br /> DECISION: The Planning Director has determined to allow for the proposed addition to the existing residence <br /> with a three foot setback from the southem (side) property line with the following condition: <br /> . Necessary building permits are to be obtained by the applicant from the City of Everett Building <br /> DepaRment. <br /> . The expansion is approved for only that portion of the building consistent with a three-foot setback. <br /> No structure may encroach further into the non-conforming selback. The staircase, which is shown <br /> on the site plan, must be relocated to be consistent with all setbacks. <br /> Right to Appeal: The applicant or an owner of property located adjacent to the subject property may appeal the <br /> Planning Director's determination as to whether or not the proposal should be permitted. Any such appeal <br /> must be filed within fourteen (14) calendar days of the date specified below. Appeal fortns are available from <br /> the Planning Department and must be submitted along with the required filing fee.
