h) There are portions of the structure that are likely to fail,or to become detached or <br /> dislodged;or tu collapse and thereby injure persons or damage property. <br /> i) The building or structure has become so dilapidated or deteriorated as to become <br /> an attractive nuisance to children, a harbor for vagrants,criminals or immoral <br /> persons, or to enable persons to resort thereto for the putpose of committing <br /> unlawful or immoral acts. <br /> j) The building has bcen abandoned in excess of six months and constitutes a hazard <br /> to the public. <br /> k) The building is not mainta=-ed in compliance with the Minimum Standazds for <br /> Vacant Buildings. <br /> I) The building and premises aze in such condition as to wnstitute a public nuisance <br /> known to the common law or in equiry jurisprudence. <br /> 3) The conditions described above have not been cortected <br /> 4) Title to the estate or interost in the subject property is vested in Richard J. Sullivan <br /> pursuant to a Statutory Warranty Deed recorded under Recording No. 7603090183. <br /> 5) On March 1, 1976, a deed of hust was executed, with Richard J. Sullivan as grantor, <br /> Pioneer Fitst Fedenl Savings& Loan Association as beneficiary, and Transamerica <br /> Title Insurance Company as trustee. Said deed of tcust was recorded under Recording <br /> No. 7603090183. <br /> 6) On September 3, 1993, a deed of trust was executed,with Richard J. Sullivan as <br /> grantor,Centrum Financial Services, Inc., as beneficiary,and Stewart Title Guaranty <br /> Company as trustee. Said deed of trust was recorded under Recording No. <br /> 9309080497. On September 17, 1993 said deed of trust was assigned to West One <br /> Bank, Washington. The Assignment of Deed of Trust was recorded under Recording <br /> No. 9309270481. <br /> 7) Other parties interest include the Everett School District, which entered into u <br /> mitigation agreement with Sullivan on April 19, 1999, and the State of Washington <br /> Employment Security Department,judgment creditor of judgment No. 97-9-02879-9. <br /> 8) The parties in Findings of Fact 3, 4, 5 and 6 were duly notified via certified mail, <br /> regulaz mail and posting of the conditions at the subject property and have had <br /> adequate notice of the opportuniry to appeaz at the hearing to appeal the City's <br /> allegations. <br /> Conclusions of Law: <br /> I) The building located upon the subject property is a substandazd building as defined in <br /> 16.08.090(L), 16.08.190(B)(13), 16.Q8.190(D), 16.08.190(H)(2), 16.08.190(I), <br /> 16.08.190(K) 16.08.190(0) of the Everett Municipal Code. <br /> 1918-1920 GRAND q <br /> CASE NO. 797-99 <br />
