The geotechnical report concludes that the proposat will not increase risk to adjacent properties i <br /> from soil instabiliry if the recommendations in the report are followed. The applicant should be tequired <br /> to compty with all recommendations in the report. <br /> Decision: The City of Everett Planning Director hereby grants approval of the request by Richard <br /> Sullivan to allow the proposed construction of an 11-12 unit condominium on the site and the alteration of <br /> lo e and buffcr sub'ect to the following conditions: <br /> the geologically hazardous s p � J �I <br /> 1. The proposal must comply with all recommendations of the geotechnical report prepared by David <br /> Evans and Associates dated August 1998 and the letter dated March I, 1999, as well as the updated <br /> report by Farth Consultants, inc. dated December 21, 2001 and any supplemental information <br /> required by this decision. <br /> 2. The proposal must comply with all Uniform Building Code requirements, including those related to <br /> excavations and shoring. <br /> 3. A copy of the final construction plans, including grading plans and building plans, must be <br /> reviewed by the Applicant's soils consultant to insure that the recommendations of the geotechnical <br /> report are adequately addressed in the building design. A written determination that the <br /> construction plans meet the requirements of the geotechnical repon must be submitted to the <br /> Planning Department prior to issuance of building permits. <br /> 4. Representatives of the Applicant's soils consultant mast monitor the site during excavation ro <br /> ensure that the recommendations of the geotechnical report are adequately implemented. The <br /> geotechnical engineer must provide the Planning Department with certification that the construction <br /> is in compliance with the their recommendations. <br /> 5. The clearing limit must be clearly shown on the plans submitted for grading permits and reviewed <br /> by the geotechnical engineer. No removal of vegetation is permitted west of the clearing limit. <br /> Following construction, any cleared areas on or directly adjacent to the slope must be hydroseeded <br /> immediately and replanred with native vegetation. The species replanted and watering practices <br /> must be approved by the geotechnical engineer. If revegetation is necessary, the georechnical <br /> engineer must submit a tetter to the Planning Department stating appropriate species and watering <br /> practices to ensure survival of plantings and protect the slope. <br /> 6. The applicant must prepate a covenant running with the land which waives claims against the Ciry, <br /> its officers, employees and agents, and indemnifies (including reasonable attorney's fees), defends <br /> and saves the City, its officers, employees and agents harntless from any loss or damage to people <br /> or properry either on or off the subject properry resulting from any form of soil movement <br /> whatsoever and/or from :my form of failure in design and/or construction of the improvements <br /> thereon whatsoever. The owners of subject properry shall provide the Ciry with the covenant and <br /> it shall be signed and acknowledgeci by all parties with an interest in the properry.
