According to Snohomish <br /> County Assessor's Records it appears that the above structure was constructed prior to <br /> December 1, 1956. A Board of Adjustment Order was issued on February 26, 7962 approving a <br /> second unit on site, even though the site did not have the required off-street parking. <br /> The duplex fails to meet the cr,de required twenty-foot front setback fr�m the eastem property line <br /> as well as the five-foot interio�side setbacks from the north and south property lines. The site <br /> also fails to meet the code required off street parking requirement for the two units. <br /> It appears a th'�d unit has ecen added to the structure. The information provided by the <br /> applicant, and on file with the City, fails to document that this third unit was in place prior to <br /> December 1, 1956 or at the time the second unit was approved through the Board of Adjustment <br /> Order issued in 1962. Since the site falls short of code required parking and steep slopes <br /> encumber the site, this third unit cannot be considered legal non-conforming. <br /> The site aiso fails to meel the minimum Iot size for the required zone. Warcanty Deed <br /> Recorded under Snohcmish County Records recurding #1455756 dated March 31, 1�61 <br /> documents that the Iot has been held as a separate legal lot prior to the zoninp code coming <br /> into effect. The applicant has submitted infortnation that shows ihe subject property is an <br /> average of 177 feet deep by 25 feet wide totaling approximately 4,425 square feet. <br /> Refer to the attached site plan, provid�d by the applicant,for information regarding specific <br /> building setbacks, building height, c�d building dimensions. <br /> Decision: I hereby find that the use and setbacks for the above stnicture(s)are recognized as <br /> legal non-conforming and meel the City of Everatt Zoning Code in effect at the time of <br /> construction. However, lhis decision does not purport to legalize the third unit which has been <br /> added to the structure. This certification is subject to revoCation if it is found that the infortnation <br /> upon which this decision was base� is erroneous.
