Weed, <br />DATE June 16,1982 <br />Assistant City Attorney <br />SUBJECT Requests for Sale of Goods <br />On City Sidewalks <br />ro <br />CITY OF EVERETT, EVERETT WASHING T�� r 19 8 "1 <br />CITY OF EVERET i' <br />worY.r D <br />You have asked me to provide you with information relating to the City's authority <br />to allow for the sale of merchandise on City sidewalks. <br />The applicable City code provisions which address the sale of goods on City <br />sidewalks are EMC 13.12.020 and EMC 13.12.030. EMC 13.12.020 reads as follows: <br />Objects on Sidewalks Unlawful - Exception. It is unlawful for any <br />person, persons, corporations or other entities to cause to be placed <br />upon any sidewalk area in the City, or permit to be placed upon or to <br />occupy any sidewalk area in the City, any object or article of any <br />sort whatsoever which may constitute an obstruction to pedestrian <br />traffic, except certain receptacles or containers, as may be approved <br />by City Council, telephone booths, as may be approved by City <br />Council, and City -owned benches or other City -owned objects which <br />serve the public convenience. <br />EMC 13.12.030 reads in relevant part as follows: <br />Objects Permitted Upon Sidewalk Areas. With the consent of the <br />City Council, upon application being made to said City Council, the <br />following objects may be placed on the sidewalk areas in the City <br />under such conditions and in such manner as the City Council may <br />approve: <br />D. Display merchandise. Display of merchandise when in con- <br />nection with a special occasion or merchant promotional <br />activity, provided such exception shall not be granted by the <br />City Council for a period in excess of 14 days. <br />It is my understanding that a particular business has requested that they be allowed <br />to display merchandise every weekend. The language of the above -cited code <br />provisions is clear that such activity may be allowed only when it is shown that it is <br />with regard to a special occasion or promotional activity approved by City Council <br />and not to exceed 14 days. <br />If the request by the local merchant <br />not associated with a special occasion <br />prohibited by City code.
