CITY OF EVERETT - BOARD OF ADJUSTMENT <br />ORDER <br />WHEREAS, theretofore, there was filed with the City of Everett Building Division <br />on August 19, 1977, an application for a variance of Section No. 08.010 of Everett <br />Municipal Code Chapter 19 by Walter Gemnill, 4231 Thompson, Everett, WA 98203, f,.)r <br />permission to front for no (0) frontage on a public dedicated street <br />rather than the code requirement of forty (e-•i ft. <br />A twenty (20) foot easement road will he provided for access to the property. <br />on the following described property: <br />The westerly 125' of Lot 11, Block 14, Victory heights Addition. <br />ADDRESS: Approximately Grand & 43rd St. <br />ZONING: R-1 Single Family Low Density Residence <br />AND: WHEREAS, September 12, 1977, was fixed as the date of hearing on said application <br />and proper notice having been given as required by law, <br />AND: WHEREAS, a public hearing was held on said date and the Board of Adjustment, <br />after reviewing all testimony, made the findings that: <br />1. One more additional residence will not significantly increase the traffic <br />hazard on Grand Avenue. <br />2. As determined from the testimony of Mr. David Brandvold, the property lying <br />east of the subject property will not be developed into any more than two (2) <br />homes and so our variance is so conditioned. <br />3. Mr. Gemmill's request complies with Section 15.04.370 which says: <br />(a) That there are exceptional or extraordinary circumstances or conditions <br />applying to the subject property or as to the intended use thereof, that <br />do not apply generally to other properties in the same vicinity or zone. <br />(b) That such variance is necessary for the preservation and enjoyment of a <br />substantial property right of the appellant possessed by the owners of <br />other properties in the same vicinity or zone. <br />(c) Trat the authorization of such variance will not be materially detri- <br />mental to tho public welfare or injurious to property in the vicinity <br />or ;one in which the property is located. <br />(d) Tnat the granting of such variance will not adversely affect the <br />comprehensive general plan. . <br />NOW, THEREFORE, based on the foregoing findings: <br />BE IT ORDERED BY THE CITY OF EVERETT BOARD OF ADJUSTMENT that said application be <br />GRANTED: <br />AND: BE IT FINALLY ORDERED that a copy of this written order be transmittE :1 to <br />the applicant for their information. <br />DATE OF ACTION: September 12, 1977. <br />If no building permit has been obtained within one year from the date of this action, <br />this order is void. <br />4,1son, secretary <br />Board of Adjustment <br />
