BOARD OF ADJUSTMENT_ <br />FINDINGS, CONCLUSIONS AND ORDER <br />VARIANCE NO. 48-87 <br />Based upon the written request for a variance from the City's •zoning code by: <br />Harlan Heil <br />4626 Greely <br />Everett, WA 98203 <br />hereinafter referred to as "Applicant," for: <br />A Variance from E.M.C. 19.14.050(A) Front Yards to allow construction <br />of a carport that would be eight feet from the front property line <br />instead of the 20 feet required by Code. <br />on the following described property: <br />Lots 23 and 24, Block 3, Queen Anne Addition to Everett <br />commonly known as: 4626 Greely _ <br />II The Board of Adjustment, following a public hearing on said application held <br />on December 7, 1987, and further having reviewed all testimony, makes the <br />following Findings, Conclusions and Order: <br />I <br />VARIANCE CRITERIA: <br />Findings and Conclusions: <br />Criterion 1: That there have been exceptional or extraordinary <br />circumstances or conditions applying to the subject property <br />or as to the intended use thereof that do not apply <br />generally to other properties in the same vicinity or zone. <br />a. Finding: The Applicant wishes to construct a carport in <br />what is technically the front vard of an existing single <br />family residence. The front of the house orients towards <br />Greely which is technically the side yard. Both Greely <br />street and Bailey Street have 80 feet of right-of-way with <br />only a twc-lane improvement so there is a great deal of <br />unused right-of-way. <br />In addition, there is an approximately two to three foot <br />drop in topography from Bailey Street to the level of the <br />technical front yard of this lot. This area has been <br />bulkheaded and the unused right-of-way has been extensively <br />landscaped by the Applicant in anticipation of constructing <br />a carport in the area. There are no plans in the <br />foreseeable future to improve Greely beyond what it is <br />currently. <br />b. Conclusion: There are exceptional circumstances applying to <br />this property. <br />Criterion 2: That such variance is necessary for the preservation and <br />enjoyment of a substantial property right of the appellant <br />possessed by vie owners of other properties in the same <br />vicinity or zone. <br />a. Finding: There are several other structures in the area <br />that extend into the 20 foot setback area. <br />b. Conclusion: The variance is necessary for the enjoyment of <br />a property right possessed by other owners in the vicinity <br />and zone. <br />
