P'-ANNING DIRECTOR DECISION <br />REVIEW PROCESS 1901-033 <br />September 10, 2001 <br />(Shawn Roten) <br />The City of Everett Planning Director grants approval of a buffer width reduction and <br />steep slope setback request by Shawn Roten dba Left Coast Construction, 521 41" Street, <br />Mukllteo, WA 98275, in order to construct a single fainiiy residence at 16XX Bailey Ave <br />with the following conditions: <br />• Full compliance with the recommendations of the geotechnical study by Geotech <br />Consultants, Inc., dated August 27, 2001 is required. <br />• Compliance with the approved buffer enhancement -planting plan is required prior to final <br />approval or occupancy of the residence. A suitable guarantee for completion of the buffer <br />enhancement plantings must be filed with the City if the plantings are not installed prior to <br />issuance of building permits. <br />• Prior to issuance of permits the Environmentally Sensitive Area buffer shall be fenced and <br />posted per the approved site plan and an Environmentally Sensitive Area Covenant <br />recorded with the Snohomish County Auditors Office. <br />The subject site consists of lots 1-5 and the east 15 feet of lot 6, Block 7, Plat of Queen Anne <br />Addition to Everett -ind is located in the 16XX block of Bailey Ave. The eastern approximately <br />two-thirds of the subject property is defined as an environmentally sensitive area due to the <br />existence of steep slopes leading to a stream corridor at the base of the slopes. The remaining <br />one-third of the site is relatively flat and is to the west of the slope and stream corridor. It <br />consists of a maintained yard area that is covered with lawn to the edge of the slope area. <br />Se::tion 37 of the City of Everett's Zoning Code requires a 25-foot native vegetation buffer and <br />building setback from the top of the slope. However, because the buffer consists entirely of <br />lawn up to the edge of the slope, the applicant proposes a buffer width reduction with <br />enhancement. Under Section 37 of the City of Everett's Zoning Code the Planning Director is <br />authorized to allow for a reduction of the steep slope buffer subject to a buffer enhancement <br />planting plan and reducticn of the typical building setback from a steep slope if he/she approves <br />a geotechnical report which demonstrates that: <br />1. the proposed development will not create a hazard to the subject property, surrounding <br />properties or rights -of -way, erosion or sedimentation to off -site properties or bodies of water; <br />and <br />
