Our critical areas maps show that this area includes a slope that is designated as a landslide <br />hazard area and has a high risk of erosion. The slope is also a buffer to Merrill and Ring Creek, a <br />fish bearing stream. Alteration of this slope and stream buffer is prohibited by section 19.37.080.E <br />of the Everett Municipal Code (EMC). <br />This letter is not intended to resolve any civil or criminal liability you may have in connection with <br />this incident but does describe what must be done to restore the slope consistent with City code <br />requirements. Within 10 days, please indicate in writing whether you agree to voluntarily <br />complete the steps described below, in which case the City will not commence a formal <br />enforcement action to accomplish restoration of this area. <br />By August 21, 2009, submit the following to the Everett Planning Department: <br />1. A restoration plan, prepared by a qualified biologist, that meets the requirements of EMC <br />19.37.250.B.2 and 19.37.260, which require restoration to a condition that is equivalent or <br />superior to its prior natural condition and interim erosion control and maintenance. The <br />restoration plan shall include the planting of a minimum of three trees at least six feet in <br />height for every one tree removed, unless the biologist recommends, and the planning <br />department approves, an alternative restoration plan. The plan must include a site plan of the <br />critical area. <br />2. A report from a qualified Geologist or Geotechnical Engineer assessing the stability of the <br />slope and recommending measures, if any, that should be taken to maintain the stability of <br />the slope. <br />3. Pay a fine of $38,000 per EMC 19.37.260.B. <br />By September 30, 2009, the following must be completed: <br />1.
