Also, the landscaping above the wall within the backyard area needs <br />to be completed, but it is more practical to re -vegetate after the poo! deck and plumbing have been <br />repaired <br />As pan of the original requirements, downed trees were to be removed from the Chris Chase property <br />(Lot 48), minor re -grading ol'the landslide material on the slope was to take place, and vegetation was to <br />be re -planted in the areas that were disturbed by the slide. With respect to Chris Chase's property, it is <br />our understanding that a restoration plan was provided to his original counsel, Jamic Jensen, by your <br />counsel oil September 10, 2009. This plan was immediately rejected by Mr. Jensen. It is also our <br />understanding that Mr. Chase was provided with a restoration proposal in a negotiated Settlement <br />Agreement that he ultimately declined to sign. We also understand that your counsel sent another <br />restoration plan to Mr. Chase's third allonncy, Bill Poster, on March 16, 2010. To date, no response has <br />been received from Mr. Poster or Mr. Chase. <br />We have reviewed demolition and landscaping plans you and your contractor prepared for completing <br />the unfinished items. The plans indicate that the area above the wall would be vegetated with mostly <br />native vegetation, the pool deck re -done, and a Fence constructed along the top of the shoring wall <br />approximately two feet away from the wall. The plans also indicate that ample access would be <br />provided to the will and drainage systems for future maintenance and emergency repairs. It is our <br />opinion that the provided landscaping plans are satisfactory From it geotechnical standpoint. <br />We understand that the remaining work will take approximately two months and that you are requesting <br />that the City grant you a two -month extension past the original April I" deadline. We recommend that <br />the restoration and re -vegetation be completed as soon as possible to allow, the vegetation time to <br />become established in the spring, and to cover sensitive areas that are still currently exposed. We also <br />recommend that the restoration be completed on Lot 48 as well, to fulfill the original agreement between <br />the Andcrsons and file Chases, and to help establish vegetation and stability to the area. We understand, <br />with regard to Lot 48, however, that no such restoration can occur until Mr. Chase pennits it to occur. <br />We oust this memorandum satisfies your needs at this time.
