EVF{REStL.i,aSj1IN,GTANpmentDept. <br />David Brandvold <br />Division of Four Lots <br />I am writing in response to your memorandum dated October 2, 1973, regarding <br />the segregation of four lots: <br />ISSUES AND FACTS: <br />In your aforementioned memorandum, you stated that the Board of Adjustment <br />had concern regarding the following fact situation: . • <br />Mr. David Brandvold applied for a variance for permission <br />to, among other things, divide each of four adjacent lots <br />into. two lots (i.e. convert four lots to eight) . Four of the <br />resulting lots front on a publicly dedicated street. The <br />other four would abut the rear of the first four lots and would be <br />connected to the street by easements. Sewer and water <br />utilities would be extended to these rear lots. <br />From these facts, the Board raised the following questions: <br />ANSIVER: <br />1. Is _his the segregation of one lot into two occurring four times, <br />or is this a replat of four lots into eight? <br />2. Dons the Board of Adjustment have jurisdiction over this <br />matter or must a formal plat be filed with the Planning Commission? <br />n <br />It is my opinion that the segregation of the above lots constitutes a <br />resubdivision of '.he property in question and a formal plat should be filed <br />with the Planning Commission. Thus, the Board of Adjustment would <br />not have jurisdiction over this matter. <br />REASON FOR OPINION <br />RCIV 58.17.030 specifies that "Every subdivision shall comply with this <br />chapter. . . ." RCIV Chapter 58.17 specifics the formal procedure a person <br />must go through in order to plat a subdivision. This procedure includes <br />
